Terms of use

These terms are the agreement between you and JNM Professional Services LLC for the use of ScanTap. By creating an account you accept them.
What ScanTap does
ScanTap gives you a digital business card with a QR code. People who open your card can save your details, choose to send you theirs, and request a meeting. You can also generate a matching email signature. Free accounts are available; if we introduce paid plans we will make the terms clear before you are charged.
Your account
- You must be at least 13 years old, and old enough to enter a contract where you live.
- Keep your password to yourself. You are responsible for what happens under your account.
- Give us an email address you can actually receive mail at — it is the only way to reset a lost password.
- One person per account. Do not impersonate anyone.
Your card is public
Anything you switch on for your card is visible to anyone who has your QR code or card link. There is no access control on a card page — that is the point of a business card. Do not put anything on your card that you would not hand to a stranger.
Contacts captured through your card — your responsibilities
When someone shares their details back with you, you become responsible for those details. ScanTap stores them for you; it does not make you compliant with the law that governs how you use them.
- Only use contacts you captured through your own card, for the purpose the person reasonably expected when they gave them to you.
- Do not add these contacts to bulk marketing, cold-call lists, or automated messaging campaigns unless you have the consent that the applicable law requires. Rules such as CAN-SPAM, the TCPA and state privacy laws are your responsibility, not ours.
- Do not sell or transfer captured contacts to a third party.
- If someone asks you to delete their details, delete them. You can do this yourself in Saved Contacts.
Things you must not do
- Use ScanTap for anything unlawful, deceptive, or harassing.
- Impersonate another person or business, or misrepresent your role or credentials on a card.
- Upload content you do not have the rights to, including logos and photographs.
- Upload malware, or point a card's tap action at a harmful or deceptive destination.
- Attempt to break, overload, probe, or reverse-engineer the service, or bypass its rate limits.
- Scrape or bulk-harvest other users' card pages.
- Resell the service, or use it to build a competing product.
Your content
What you put on your card stays yours. You grant us only the licence we need to run the service — to store your content and display it on your card, QR code, card image and email signature. You confirm you have the right to use everything you upload, including any business logo.
Availability
We aim to keep ScanTap running but we do not promise uninterrupted service. We may change, suspend or discontinue features. If we plan to retire something you rely on, we will give reasonable notice where we can.
Ending your use
You can delete your account at any time from the app's dashboard; the effect of that is described in the privacy policy. We may suspend or terminate an account that breaks these terms, or where required by law. If we terminate your account without cause, we will tell you why where we are able to.
Disclaimers and liability
ScanTap is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or lost business opportunities. Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Nothing here limits liability for fraud, or for anything else that cannot lawfully be limited.
Indemnity
You agree to cover us against claims arising from your use of ScanTap in breach of these terms — in particular claims about how you used contacts captured through your card, or content you uploaded that you did not have the rights to.
Changes to these terms
We may update these terms. The date at the top of this page shows when. If a change is material we will tell you in the app or by email before it takes effect; continuing to use ScanTap after that means you accept the new terms.
Governing law
These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. The courts of Ohio have jurisdiction over any dispute, and you and we each consent to that venue.
